Regular Session, 2008 HOUSE BILL NO. 286 BY REPRESENTATIVE MORRELL CRIME/DOGFIGHTING: Amends provisions of law regarding dogfighting 1 AN ACT 2 To amend and reenact R.S. 14:102.5(C) and (D) and to repeal R.S. 14:102.5(E), relative to 3 dogfighting; to provide for penalties; and to provide for related matters. 4 Be it enacted by the Legislature of Louisiana: 5 Section 1. R.S. 14:102.5 is hereby amended and reenacted to read as follows: 6 §102.5. Dogfighting; training and possession of dogs for fighting 7 * * * 8 C. Whoever violates any provision of Paragraphs (1) through (5) and (7) of 9 Subsection A of this Section shall be fined not less than one thousand dollars nor 10 more than twenty-five thousand dollars, or be imprisoned with or without hard labor 11 for not less than one year nor more than ten years, or both. 12 D. Whoever violates Paragraph (6) of Subsection A of this Section shall be 13 fined not more than five hundred dollars or be imprisoned for not more than six 14 months, or both. 15 E. D. Nothing in this Section shall prohibit any of the following activities: 16 (1) The use of dogs for hunting. 17 (2) The use of dogs for management of livestock by the owner, his 18 employees or agents, or any other person having lawful custody of livestock. 19 (3) The training of dogs or the possession or use of equipment in the training 20 of dogs for any purpose not prohibited by law. [R.S. 1:13(B) and 24:177(E)] Morrell HB No. 286 Abstract: Provides that anyone found guilty of dogfighting, owning a dogfighting facility, advertising dogfighting, keeping dogs or paraphernalia for dogfighting, or attending dogfighting events shall be fined not less than $1,000 nor more than $25,000 or be imprisoned with or without hard labor for not less than one nor more than 10 years, or both. Present law prohibits the intentional owning, possessing, or training of a dog for the purposes of dogfighting. Present law provides that persons guilty of owning, possessing, or training of a dog for the purposes of dogfighting shall be fined not less than $1,000 nor more than $25,000 or be imprisoned with or without hard labor for not less than one nor more than 10 years, or both. Present law provides that spectators at dogfighting events shall be fined not more than $500 or imprisoned for not more than six months or both. Proposed law removes the separate penalty for spectators at dogfighting events and provides that the same penalties shall be imposed on spectators as those imposed on persons participating in dogfighting events.
